ASA Signs Letter Urging Inclusion of Conservation Easement Provisions in Build Back Better Act

by Jessica Wilhelmy | Dec 07, 2021

On December 3rd, ASA joined thirteen organizations in signing a letter to Senator Kyrsten Sinema (D-AZ) urging inclusion of the bipartisan Charitable Conservation Easement Program Integrity Act in the Build Back Better Act.

Approximately 2,000 to 2,500 conservation donations are made each year; totaling around $1 billion in claimed deductions. In 2018, $9.2 billion was claimed by syndicators. The 2020 Senate Finance Committee report concluded that misuse of the program resulted in $36 billion in fraudulent tax deductions from 2010 – 2018. Passage of the act remains the fastest and most efficient way to halt abuse of the conservation easement tax deduction, and is necessary to save taxpayers billions of dollars each year while preserving legitimate conservation easements.

ASA supports the passage of the Charitable Conservation Easement Program Integrity Act and urges Senator Sinema to include the act into the budget reconciliation package. To read the letter sent to Senator Sinema, click here.
