Business Valuation Related Experience:

Mr. Fleming is nationally and internationally accredited in accounting, financial reporting, forensic financial analysis, business valuation, valuation of intangible assets and intellectual property, and corporate finance and strategy. He has led over 1,000 valuations and/or analytical projects across virtually all industries, and has performed such services for businesses ranging in size from Main Street to publicly-traded companies. In addition to mainstream finance issues, he is regularly involved with startups, acquisitions, spinoffs, joint ventures and other complicated business relationships. He regularly values financial instruments such as notes, warrants, stock appreciation rights, etc. Further, he has valued industrial plants, machine lines, and fleets of income producing tangible assets using income based approaches to value. He is skilled in the valuation of intangible assets, including patents, trademarks, trade secrets, designs, technology platforms, software, computer code, and others.

Mr. Fleming has valued unique intellectual property on several occasions, including FCC permits, undersea telephonic cables, international marine fisheries quotas, FAA certificates, pharmaceutical formularies, FDA drug approvals, international joint ventures, and others. Formerly employed by one of the world’s largest valuation firms, he has valued companies in the US, UK, EU, Canada, Mexico, South America, Asia, and the Caribbean Basin.  He has valued or managed the valuation of the operations and/or intellectual property holdings of companies that are household names across numerous industries worldwide, including but not limited to:

In 2012 Mr. Fleming completed a six week diplomatic mission to Indonesia on behalf of the U.S. Agency for International Development, where he assisted the Ministry of Finance in forming policy around valuation and financial reporting in respect of public capital markets and cross-border trade under International Financial Reporting Standards. He is the first American business valuation executive to provide continuing professional education to officers of the Indonesian Ministry of Finance and Certified Appraisers (MAPPICert.) of Masyarakat Profesi Penilai Indonesia.

Mr. Fleming is regularly called upon to provide expert opinions in connection with litigation and quasi-judicial proceedings. He has provided direct and/or deposition testimony in several jurisdictions in Illinois and Florida. Additionally, he has participated in numerous pre-trial conferences and mediation and arbitration proceedings.

Cases requiring testimony in the last four years include:

Ingenuity, Inc. v. Linshell Innovations Limited et al, 6:11-cv-93-JA-KRS, United States District Court for the Middle District of Florida, Orlando Division. Breach of distributorship agreement and alleged total destruction of the business enterprise. Consumer packaged goods. Engaged by defendant counsel, Greenburg Traurig. Testimony by deposition. Dismissed on summary judgment. On appeal, United States Court of Appeals for the 11th Circuit; 15-10214, January 1, 2015.

Hume V. Hume, Florida 7th Judicial Circuit. Dissolution of marriage and division of marital estate. Direct and cross examination testimony. Accredited to expert status by magistrate judge, business valuation, corporate finance and intellectual property. Pending matter; full bench trial scheduled October, 2015.

Blayde Development, Inc. v. CNH Capital America, LLC, adv., Seminole County Circuit Court Case No. 07-CA-3339-16-L. Breach of contract by alleged unlawful repossession of heavy construction equipment resulting in the alleged destruction of a business enterprise. Engaged by defendant counsel, Zimmerman, Kiser, Sutcliffe. Dismissed with prejudice.
